(CC Custom Graphics’ business with client hereinafter referred to as “project”)
CC Custom Graphics agrees to provide the following service:
1. Utilize high quality materials such as but not limited to, PPG and House of Kolor automotive refinish products.
2. Offer fair and just pricing based on the general marketplace and type of project.
3. Turn the project over within a reasonable timeframe based on the complexity of the project or an agreed-upon deadline.
4. Insure the total value of client’s project parts and/or equipment while in the care of CC Custom Graphics.
5. Guarantee the client’s project finish quality is among the highest based on industry standards.
6. Warrant the project against material failures and craftsmanship for a period of one year from the date of completion on all metal substrates, 90 days on fiberglass, 30 days on plastic.
Client agrees to the following terms and conditions of this agreement:
1. All projects/work and/or balances must be paid in full upon completion/delivery or return of project to client. A 15% service charge will be added for all returned checks.
2. Client must be available during the process of the project so as to reduce the turnover time and the project can be completed and returned for payment in a timely manner.
3. Extra work and/or design changes not agreed upon in the original scope will be subject to additional fees.
4. Provide a 50% down payment on the agreed upon or the estimated total price of the project if deemed necessary by CC Custom Graphics.
5. Current service rate is $45 per hour plus material cost and additional fees for specialty products. Current service rate is $70 per hour for all repair work such as, but not limited to, body damage, dents, deep scratches, fiberglass and plastic repair.
6. If client fails to receive and pay for completed project within 10 days following the date of completion, client agrees to pay 6% interest on project remaining balance compounded weekly and $50 per week storage fee.
7. If client fails to receive and pay for completed project within 90 days following the date of completion, the client relinquishes all rights of ownership, forfeits any down payment(s) and/or deposit(s) and said project becomes the sole property of CC Custom Graphics.
8. CC Custom Graphics will not be responsible for damages caused by metal fatigue, prior damage to any parts, fuel, fuel and/or oil tank weld failures and/or sealing including, but not limited to, fuel cap(s) and all fittings, all frame and structural welds unless fabricated by CC Custom Graphics. All project parts received by CC Custom Graphics must be properly welded, tested and/or sealed by others, and any and all guidelines stated by manufacturer for such project parts must be strictly adhered to by client. CC Custom Graphics cannot warrant any finishes on engine parts or any other mechanical components subjected to abnormal or excessive heat, stress or wear.
9. CC Custom Graphics will not be responsible for project finish damage caused by assembly and/or reassembly by others. Some minor finish damage will occur by assembly fasteners during assembly/reassembly and is considered inevitable. Damage to finish sustained by assembly/reassembly that requires refinishing or finish repair cannot be warranted by CC Custom Graphics.
10. All fiberglass and plastic parts finishes will not be warranted against cracking, peeling, deformation, or any other defect caused by stress, wear, prior contamination, assembly/reassembly, and/or over- flexing.
11. Any damage sustained to project parts, after delivery to client, such as but not limited to, fire, flood, accident, and/or any act of God cannot be warranted by CC Custom Graphics once said project is no longer in the care of CC Custom Graphics.
12. Client acknowledges and agrees that any and all work performed by CC Custom Graphics and its’ affiliates may be used for any type of advertising purpose, such as but not limited to, internet marketing and promotion, and gives express permission to use all names associated and photographs involved in project at its’ discretion.
This agreement and any attached addendum constitute the entire agreement between parties and no oral statements shall be binding. It is the intention of the parties herein that if any part of this agreement is invalid; such invalidity shall not void the remainder of this agreement.
My signature is proof of my intentions as a Client of CC Custom Graphics to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law, have read and understand all the terms and conditions stated herein on this_________day of ___________________ ____________ .
